Terms of Service

Effective April 11, 2026 — Core Values Recovery LLC

1. Agreement

By creating an account or using On the Beam (the “Service”), you agree to these Terms of Service (“Terms”). If you do not agree, do not use the Service. These Terms constitute a binding agreement between you and Core Values Recovery LLC (“Company,” “we,” “us”).

2. Eligibility

• You must be at least 18 years old to use the Service.
• You must provide accurate account information and keep it current.
• Clients access the Service through an invitation from a licensed or certified recovery coach.

3. Description of Service

On the Beam provides:

• AI coaching companion — an artificial intelligence tool that provides conversational coaching support. The AI is not a human and is not a licensed therapist or counselor.
• Human coach oversight — your assigned recovery coach supervises your coaching relationship, including AI interactions, and can intervene at any time.
• Recovery tools — check-ins, to-do lists, meeting tracking, and other features to support your recovery.
• Substance testing — when enabled by your coach, tools for submitting and reviewing substance tests.

4. Not Medical Care

The Service is not medical advice, therapy, counseling, or clinical treatment. The AI coaching companion is not a licensed healthcare provider. Nothing in the Service should be considered a medical diagnosis or treatment recommendation. If you need medical care, contact a licensed healthcare provider. If you are in crisis, call 988, text HOME to 741741, or call 911.

5. AI Disclosure (California SB 243)

In compliance with California Senate Bill 243, we disclose: the AI coaching companion within On the Beam is powered by artificial intelligence. It is not a human. Your human recovery coach supervises all AI interactions.

6. Your Account

• You are responsible for maintaining the confidentiality of your account credentials.
• You must not share your account with any other person.
• You must notify us immediately if you suspect unauthorized access to your account.
• We may suspend or terminate your account for violations of these Terms.

7. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to any part of the Service
• Interfere with or disrupt the Service or its infrastructure
• Impersonate another person or entity
• Use the Service to harass, threaten, or harm another person
• Attempt to reverse-engineer, decompile, or extract source code from the Service
• Use automated tools (bots, scrapers) to access the Service
• Share testing submission media or coaching content outside the platform

8. Coach Responsibilities

If you use the Service as a recovery coach:

• You represent that you hold appropriate credentials, certifications, or licenses for recovery coaching in your jurisdiction.
• You are responsible for the accuracy and appropriateness of any coaching guidance you provide through the platform.
• You agree to review AI-generated interactions for your clients in a timely manner.
• You must comply with all applicable laws, regulations, and professional standards, including HIPAA.
• You must not disable safety features (risk detection, crisis resources) for your clients.

9. Privacy and Data Protection

Our collection and use of your data is governed by our Privacy Policy and Notice of Privacy Practices. By using the Service, you acknowledge that you have reviewed these documents.

10. Intellectual Property

The Service, including its design, code, AI models, and content (excluding your personal data), is owned by Core Values Recovery LLC and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or distribute any part of the Service without our written permission.

11. Your Content

You retain ownership of the content you create through the Service (messages, check-in responses, notes). By using the Service, you grant us a limited license to store, process, and display your content as necessary to operate the Service and provide coaching support.

12. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee that:

• The Service will be uninterrupted or error-free
• The AI coaching companion will provide accurate, complete, or appropriate responses in all situations
• The Service will meet your specific recovery needs

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CORE VALUES RECOVERY LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNTS YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

14. Indemnification

You agree to indemnify and hold harmless Core Values Recovery LLC, its officers, directors, employees, and agents from any claims, losses, or damages (including reasonable attorney fees) arising from your use of the Service or violation of these Terms.

15. Termination

• You may stop using the Service at any time.
• You may request deletion of your account by contacting privacy@getonthebeam.com.
• We may suspend or terminate your access for violation of these Terms, with notice where practicable.
• Upon termination, your right to use the Service ceases. Data retention after termination is governed by our Privacy Policy and applicable law.

16. Governing Law

These Terms are governed by the laws of the State of Utah, without regard to conflict-of-law principles. Any disputes arising from these Terms shall be resolved in the state or federal courts located in Utah.

17. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes through the app or by email. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

18. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

19. Entire Agreement

These Terms, together with the Privacy Policy and Notice of Privacy Practices, constitute the entire agreement between you and Core Values Recovery LLC regarding the Service.
